Law Director files motion to dismiss case to remove Wirebaugh from City Council

BUCYRUS—A Bucyrus woman who filed a malfeasance suit to remove Bucyrus Councilman At-Large Dan Wirebaugh from council has received her response from the city.

In documents filed this morning in the Crawford County Common Pleas Court, City Law Director Brian Gernert asked that a suit filed by Bucyrus resident Carolyn Shireman be dismissed.

According to the Ohio Revised Code (733.72), Shireman cannot, as a private citizen, bring a malfeasance or misfeasance charge against an elected official. That charge has to be brought by the Law Director.
Gernert has answered the suit and asked the court to dismiss Shireman‘s case.

“Disenfranchising the electorate of the City of Bucyrus is not something I take lightly. The City of Bucyrus choose Mr. Wirebaugh to represent their interests, and without substantial grounds specifically relating to and affecting his ability to perform his duties and directly affecting the rights and interests of the public, it is not right to overthrow the will of the voters,” Gernert told Crawford County Now.
